Which US Letter Did You Get?
US buyers usually get one of two kinds of letter. They come from different agencies and give you different options, so check the letterhead first.
1. A CBP Notice of Seizure
Under 19 CFR 162.31, Customs and Border Protection must send written notice to each party with an interest in the seized property. The notice has to state "the provisions of law alleged to have been violated" and tell you of your right to ask for relief under 19 U.S.C. 1618.
- Deadline: a petition for relief from a seizure "must be filed within 30 days from the date of mailing of the notice of seizure" (19 CFR 171.2). File it with the Fines, Penalties and Forfeitures office named in the letter. That office can extend the time.
- Form: a petition "need not be in any particular form" (19 CFR 171.1). It must describe the property, the date and place of the seizure, the facts you rely on, and your interest in the property.
- Warning: the same rule says a false statement in a petition can be prosecuted under 18 U.S.C. 1001. Don't claim a prescription you don't have.
2. An FDA refusal notice
Under 21 U.S.C. 381(a), CBP can pass imported drugs to the FDA, "with notice of such delivery to the owner or consignee," who may "introduce testimony". An unapproved or misbranded drug "shall be refused admission". A refused article is destroyed unless it is exported within 90 days of the refusal notice.
Why modafinil gets stopped at all
Modafinil is a Schedule IV controlled substance in the US. 21 CFR 1312.11(b) bars anyone from importing a non-narcotic Schedule III, IV or V substance "unless and until such person is properly registered" with the DEA and has filed an import declaration. Personal buyers of mailed orders don't hold that registration. That's why a seized package is a legal loss rather than a paperwork error, and why reship policies exist.
Quick answers
Can I ignore a customs seizure letter? You can choose not to petition. The goods are then treated as forfeited or refused, and the vendor's reship policy is your only route to replacement. If you want to contest the seizure, the 30-day petition window in 19 CFR 171.2 applies.
Is modafinil illegal in the US? It's a Schedule IV prescription drug. Possession with a valid prescription is legal. Importing it by mail without DEA registration isn't allowed under 21 CFR 1312.11. See our US guide.
Should I hire a lawyer? For a personal-use quantity of a Schedule IV drug, most buyers just accept the loss and claim the reship. If the letter mentions penalties or a fine, talk to a customs lawyer before you reply. This page isn't legal advice.
